h) ‘processor’ means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller,
i) ‘recipient’ means a natural or legal person, public authority, agency or another body, to which the personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law shall not be regarded as recipients; the processing of those data by those public authorities shall be in compliance with the applicable data protection rules according to the purposes of the processing,
j) ‘third party’ means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorized to process personal data,
k) ‘consent’ of the data subject means any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her,
l) ‘personal data breach’ means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, personal data transmitted, stored or otherwise processed,
m) ‘data concerning health’ means personal data related to the physical or mental health of a natural person, including the provision of health care services, which reveal information about his or her health status.

2. Responsible for the Privacy Policy of this website.
2.1. Responsible for the Privacy Policy, processor and controller of the users’ personal data is e-psychotherapy.com.
2.2. If the Terms of Use according to the EU General Data Protection Regulation (“GDPR”) require further updating or completion in the future, the site users will be informed about such changes in order to gain full knowledge about them and to resume their consent to the updated Terms of Use of the Website.
2.3. Copyright of the content of this website belongs to the owner and administrator e-psychotherapy.com. e-psychotherapy.com makes every effort to ensure that the service of this website is provided with care and respect. However, e-psychotherapy.com does not fully guarantee that its operation willalways be uninterrupted due to force majeure or technical problems caused by the internet service provider. In any case, e-psychotherapy.com reserves the right to update, extend, improve, and modify all of the Website’s service, with or without noticing its users.
2.4. It is allowed to reproduce part or the full content of this website only by indicating the source.

3. Service Content.
3.1. The online counseling service provided by this website does not replace the mental health specialist (psychologist or psychiatrist or neurologist), the psychotherapeutic process and the medical help provided during a real-life therapy session. If you are taking medication or you are currently visiting a psychiatrist or a neurologist, please inform us. Also, please inform him about your wish to participate to an online counseling session in order to get his consensus.
3.2 IF YOU ARE THINKING ABOUT SUICIDE OR IF YOU ARE CONSIDERING HARMING YOURSELF OR OTHERS OR IF YOU FEEL THAT ANY OTHER PERSON MAY BE IN ANY DANGER OR IF YOU HAVE ANY MEDICAL EMERGENCY, YOU MUST IMMEDIATELY CALL THE EMERGENCY SERVICE NUMBER OF YOUR COUNTRY AND NOTIFY THE RELEVANT AUTHORITIES. SEEK IMMEDIATE IN PERSON ASSISTANCE. THE PLATFORM IS NOT DESIGNED FOR USE IN ANY OF THE AFOREMENTIONED CASES AND THE COUNSELORS CANNOT PROVIDE THE ASSISTANCE REQUIRED IN ANY OF THE AFOREMENTIONED CASES.
3.3 THE PLATFORM IS NOT INTENDED FOR THE PROVISION OF CLINICAL DIAGNOSIS REQUIRING AN IN-PERSON EVALUATION AND YOU SHOULD NOT USE IT IF YOU NEED ANY OFFICIAL DOCUMENTATION OR APPROVALS FOR PURPOSES SUCH AS, BUT NOT LIMITED TO, COURT-ORDERED COUNSELING OR EMOTIONAL SERVICE DOG CERTIFICATION. IT IS ALSO NOT INTENDED FOR ANY INFORMATION REGARDING WHICH DRUGS OR MEDICAL TREATMENT MAY BE APPROPRIATE FOR YOU, AND YOU SHOULD DISREGARD ANY SUCH ADVICE IF DELIVERED THROUGH THE PLATFORM.
3.4 DO NOT DISREGARD, AVOID, OR DELAY IN OBTAINING IN-PERSON CARE FROM YOUR DOCTOR OR OTHER QUALIFIED PROFESSIONAL BECAUSE OF INFORMATION OR ADVICE YOU RECEIVED THROUGH THE PLATFORM.
3.5. Any article published or republished in this website contains scientific data and different points of view that do not constitute personalized diagnosis or direct advice and they cannot guarantee the results of the therapy sessions.
3.6. e-psychotherapy.com provides the service of online counseling via any available electronic means (Skype, email, e-mail, etc.) that is compatible to the administrator of this website and the user upon agreement. For a full and effective service, please communicate us the truth about you and your concerns. False and inaccurate statements prevent the proper counseling process.
3.7. The user should deposit the reward (send us an email to send you the prices) for the service to the bank account that e-psychotherapy.com will indicate before the start of the online counseling session.
e-psychotherapy.com will sent via email the bill of rendered services to the user within a reasonable time. The reward is not refundable.

4. Disclaimer of Warranty and Limitation of Liability
4.1 YOU HEREBY RELEASE US AND AGREE TO HOLD US HARMLESS FROM ANY AND ALL CAUSES OF ACTION AND CLAIMS OF ANY NATURE RESULTING FROM THE COUNSELOR SERVICES OR THE PLATFORM, INCLUDING (WITHOUT LIMITATION) ANY ACT, OMISSION, OPINION, RESPONSE, ADVICE, SUGGESTION, INFORMATION AND/OR SERVICE OF ANY COUNSELOR AND/OR ANY OTHER CONTENT OR INFORMATION ACCESSIBLE THROUGH THE PLATFORM.
YOU UNDERSTAND, AGREE AND ACKNOWLEDGE THAT THE PLATFORM IS PROVIDED “AS IS” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, NON-INFRINGEMENT, SECURITY, FITNESS FOR A PARTICULAR PURPOSE OR ACCURACY. THE USE OF THE PLATFORM IS AT YOUR OWN RISK. TO THE FULLEST EXTENT OF THE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED.
4.2 YOU UNDERSTAND, AGREE AND ACKNOWLEDGE THAT WE SHALL NOT BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES.
4.3 YOU UNDERSTAND, AGREE AND ACKNOWLEDGE THAT OUR AGGREGATE LIABILITY FOR DAMAGES ARISING WITH RESPECT TO THIS AGREEMENT AND ANY AND ALL USE OF THE PLATFORM WILL NOT EXCEED THE TOTAL AMOUNT OF MONEY PAID BY YOU THROUGH THE PLATFORM IN THE 3 MONTHS PERIOD PRIOR TO THE DATE OF THE CLAIM.

5. Your account, representations, conduct and commitments
5.1 You hereby confirm that you are legally able to consent to receive Services, or have the consent of a parent or guardian, and that you are legally able to enter into a contract.
5.2 You hereby confirm and agree that all the information that you provided in or through the Platform, and the information that you will provide in or through the Platform in the future, is accurate, true, current and complete. Furthermore, you agree that during the term of this Agreement you will make sure to maintain and update this information so it will continue to be accurate, current and complete.
5.3You agree, confirm and acknowledge that you are responsible for maintaining the confidentiality of your password and any other security information related to your account (collectively “Account Access”).
5.4You agree to notify us immediately of any unauthorized use of your Account Access or any other concern for breach of your account security.
5.6You agree, confirm and acknowledge that we will not be liable for any loss or damage that incurred as a result of someone else using your account, either with or without your consent and/or knowledge.
5.6You agree, confirm and acknowledge that you are solely and fully liable and responsible for all activities performed using your Account Access. You further acknowledge and agree that we will hold you liable and responsible for any damage or loss incurred as a result of the use of your Account Access by any person whether authorized by you or not, and you agree to indemnify us for any such damage or loss.
5.7You agree and commit not to use the account or Account Access of any other person for any reason.
5.8You agree and confirm that your use of the Platform, including the Counselor Services, are for your own personal use only and that you are not using the Platform or the Counselor Services for or behalf of any other person or organization.
5.9You agree and commit not to interfere with or disrupt, or attempt to interfere with or disrupt, any of our systems, services, servers, networks or infrastructure, or any of the Platform’s systems, services, servers, networks or infrastructure, including without limitation obtaining unauthorized access to the aforementioned.
5.10You agree and commit not to make any use of the Platform for the posting, sending or delivering of either of the following: (a) unsolicited email and/or advertisement or promotion of goods and services; (b) malicious software or code; (c) unlawful, harassing, privacy invading, abusive, threatening, vulgar, obscene, racist or potentially harmful content; (d) any content that infringes a third party right including intellectual property rights; (e) any content that may cause damage to a third party; (f) any content which may constitute, cause or encourage a criminal action or violate any applicable law.
5.11You agree and commit not to violate any applicable local, state, national or international law, statute, ordinance, rule, regulation or ethical code in relation to your use of the Platform and your relationship with the Counselors and us.
5.12If you receive any file from us or from a Counselor, whether through the Platform or not, you agree to check and scan this file for any virus or malicious software prior to opening or using this file.
5.13You will indemnify us, defend us, and hold us harmless from and against any and all claims, losses, causes of action, demands, liabilities, costs or expenses (including, but not limited to, litigation and reasonable attorneys’ fees and expenses) arising out of or relating to any of the following: (a) your access to or use of the Platform; (b) any actions made with your account or Account Access whether by you or by someone else; (c) your violation of any of the provisions of this Agreement; (d) non-payment for any of the services (including Counselor Services) which were provided through the Platform; (e) your violation of any third party right, including, without limitation, any intellectual property right, publicity, confidentiality, property or privacy right. This clause shall survive expiration or termination of this Agreement.
You confirm and agree to use only credit cards or other payment means (collectively “Payment Means”) which you are duly and fully authorized to use, and that all payment related information that you provided and will provide in the future, to or through the Platform, is accurate, current and correct and will continue to be accurate, current and correct.
You agree to pay all fees and charges associated with your Account on a timely basis and according to the fees schedule, the terms and the rates as published in the Platform. By providing us with your Payment Means you authorize us to bill and charge you through that Payment Means and you agree to maintain valid Payment Means information in your Account information.
5.13If you have any concerns about a bill or a payment, please contact us immediately by sending an email to contact@e-psychotherapy.com. We will evaluate your issue on a case by case basis and, at our discretion, take steps to resolve any issue, including but not limited to helping you find a new Counselor, extending your subscription at no cost to you, and issuing partial or full refunds when applicable.

6. Modifications, Termination, Interruption and Disruptions to the Platform
6.1 You understand, agree and acknowledge that we may modify, suspend, disrupt or discontinue the Platform, any part of the Platform or the use of the Platform, whether to all clients or to you specifically, at any time with or without notice to you. You agree and acknowledge that we will not be liable for any of the aforementioned actions or for any losses or damages that are caused by any of the aforementioned actions.
6.2 The Platform depends on various factors such as software, hardware and tools, either our own or those owned and/or operated by our contractors and suppliers. While we make commercially reasonable efforts to ensure the Platform’s reliability and accessibility, you understand and agree that no platform can be 100% reliable and accessible and so we cannot guarantee that access to the Platform will be uninterrupted or that it will be accessible, consistent and timely.

7. SOCIAL MEDIA
7.1 As part of the functionality of the Site, you may link your account with online accounts you have with third-party service providers (each such account, a “Third-Party Account”) by either: (1) providing your Third-Party Account login information through the Site; or (2) allowing us to access your Third-Party Account, as is permitted under the applicable terms and conditions that govern your use of each Third-Party Account. You represent and warrant that you are entitled to disclose your Third-Party Account login information to us and/or grant us access to your Third-Party Account, without breach by you of any of the terms and conditions that govern your use of the applicable Third-Party Account, and without obligating us to pay any fees or making us subject to any usage limitations imposed by the third-party service provider of the Third-Party Account.
7.2 By granting us access to any Third-Party Accounts, you understand that (1) we may access, make available, and store (if applicable) any content that you have provided to and stored in your Third-Party Account (the “Social Network Content”) so that it is available on and through the Site via your account, including without limitation any friend lists and (2) we may submit to and receive from your Third-Party Account additional information to the extent you are notified when you link your account with the Third-Party Account. Depending on the Third-Party Accounts you choose and subject to the privacy settings that you have set in such Third-Party Accounts, personally identifiable information that you post to your Third-Party Accounts may be available on and through your account on the Site. Please note that if a Third-Party Account or associated service becomes unavailable or our access to such Third-Party Account is terminated by the third-party service provider, then Social Network Content may no longer be available on and through the Site. You will have the ability to disable the connection between your account on the Site and your Third-Party Accounts at any time.
7.3 PLEASE NOTE THAT YOUR RELATIONSHIP WITH THE THIRD-PARTY SERVICE PROVIDERS ASSOCIATED WITH YOUR THIRD-PARTY ACCOUNTS IS GOVERNED SOLELY BY YOUR AGREEMENT(S) WITH SUCH THIRD-PARTY SERVICE PROVIDERS.
7.4 We make no effort to review any Social Network Content for any purpose, including but not limited to, for accuracy, legality, or non-infringement, and we are not responsible for any Social Network Content. You acknowledge and agree that we may access your email address book associated with a Third-Party Account and your contacts list stored on your mobile device or tablet computer solely for purposes of identifying and informing you of those contacts who have also registered to use the Site. You can deactivate the connection between the Site and your Third-Party Account by contacting us using the contact information below or through your account settings (if applicable). We will attempt to delete any information stored on our servers that was obtained through such Third-Party Account, except the username and profile picture that become associated with your account.error-free at all times.

8. SUBMISSIONS
8.1 You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding the Site (“Submissions”) provided by you to us are non-confidential and shall become our sole property. We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.
8.2 You hereby waive all moral rights to any such Submissions, and you hereby warrant that any such Submissions are original with you or that you have the right to submit such Submissions. You agree there shall be no recourse against us for any alleged or actual infringement or misappropriation of any proprietary right in your Submissions.

If you decide to leave the Site and access the Third-Party Websites or to use or install any Third-Party Content, you do so at your own risk, and you should be aware these Terms and conditions no longer govern.

Any purchases you make through Third-Party Websites will be through other websites and from other companies, and we take no responsibility whatsoever in relation to such purchases which are exclusively between you and the applicable third party.

Additionally, you shall hold us harmless from any losses sustained by you or harm caused to you relating to or resulting in any way from any Third-Party Content or any contact with Third-Party Websites.

10.1 We allow advertisers to display their advertisements and other information in certain areas of the Site, such as sidebar advertisements or banner advertisements. If you are an advertiser, you shall take full responsibility for any advertisements you place on the Site and any services provided on the Site or products sold through those advertisements.
10.2 Further, as an advertiser, you warrant and represent that you possess all rights and authority to place advertisements on the Site, including, but not limited to, intellectual property rights, publicity rights, and contractual rights.

12. SITE MANAGEMENT

(1) monitor the Site for violations of these Terms and Conditions;
(2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms and Conditions, including without limitation, reporting such user to law enforcement authorities;
(3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof;
(4) in our sole discretion and without limitation, notice, or liability, to remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems;
(5) otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site.

13. Age limit.
13.1. Any user willing to use the service provided by this website should be an adult (over 18 years old). An underage can participate to an online counseling session after the expressed consensus of his guardian has been given.
13.2. If an underage uses the service without his guardian’s consensus due to false information given by him or her intentionally concerning his age, the website holds no responsibility.

14. Processing of personal data.
14.1. During your visit/ navigation in this website (i.e. without filling any kind of form or creating a personal account) your Internet Protocol (IP) has been collected automatically for security purposes. No other personal data has been collected. Your Internet Protocol (IP) address has been collected only for statistics.
14.2. Any user who wishes to contact e-psychotherapy.com in order to get an online counseling or to get answers to his queries he can:
A) Send an e-mail (e mail) to info@e-psychotherapy.comIn this case e-psychotherapy.com receives the personal data concerning the user’s emailaddress, that the latter has transmitted voluntarily.
B) Fill in the online contact form, which requires your e mail address and a text that summarizes the reason of your contact. You can fill in your name and/ or surname or another name. These data are accessible to e-psychotherapy.com exclusively and are used only for providing the proper and efficient online counseling you asked for.
C) If the user wishes to register and create a personal account to this website, he must set a personal password and a user name. The user is the only one responsible for the management of his account and for all the operations he performs through his or her username / password. He is also responsible for keeping his account safe and not accessible to third parties.
14.3. All the aforementioned personal data are being processed fairly and lawfullyby e-psychotherapy.com after giving your consent. We collect only the personal data that are affiliated to the purpose of online counseling. Theacknowledgement of this information helps us communicate and share an efficient online counseling session. Any personal data transmitted voluntarily by the user is considered confidential and is protected just like the aforementioned personal data.
14.4. When a contract of online counseling service is running, e-psychotherapy.com may process personal data of the user. The purpose of theprocessing is to fulfill the goals of the provided service.
14.5. We guarantee strict confidentiality of these personal data, restriction of processing by third parties and non-use for commercial or advertising purpose or for any other purpose not related to the provided service.
14.6. When the reward for the provided online service is about to get paid, the user must fill in the form with the data needed to make the deposit, such as the information concerning his credit card. These data are transferred only to the bank for the payment of the deposit.
14.7. The use of unauthentic personal data is punishable. Accusations to legal authorities may follow.

15. Confidentiality.
15.1. The online counseling sessions are confidential such as any therapy session. Consequently, it is strictly forbidden to notify a third party of the content of the online session that took place between e-psychotherapy.com and a user. A removal of the confidentiality is possible only under the following conditions: (a) if there is a ruling by the judicial or prosecuting authorities after the request of a third party claiming a legitimate interest and in accordance with the lawful procedures, (b) if it is asked by other bodies of the Greek State, which according to their constitutional provisions, have such a right and competence.

16. User Rights.
16.1. The user has the right to withdraw his / her consent to the Terms of Use of this website. However, this results to the termination of our online counseling service agreement, which cannot take place without processing the particular personal data.
16.2. The user has the right to request at will and without giving any specific reason the erasure of his / her personal data by e-psychotherapy.com.
16.3. The user has the right at any time to access the personal data that are being processed by e-psychotherapy.com, who is obligated to inform him about the purposes of the processing.
16.4. The user has the right at any time to request the rectification of inaccurate personal data that are being processed.
16.5. The user has the right to obtain from the controller restriction of processing. Where processing has been restricted such personal data shall, with the exception of storage, only be processed with the user’s (a.k.a. data subject’s) consent or for the establishment, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.
16.6. For the exercise of these rights, no financial burden is imposed on the user. The user can inform e-psychotherapy.com about his decision to exercise any of the aforementioned rights at the address contact@e-psychotherapy.com

17. User Responsibilities.
17.1. The user is responsible for any damage caused by malicious or improper use of the provided service.
